On the eve of tomorrow’s trial, Judge Julie Frantz determined that, based on the recent media attention, Judge Vance Day could not receive a fair trial in Marion County.
Judge Frantz cited the decision by the Oregon Supreme Court as having a prejudicial effect upon Judge Day’s right to an impartial jury. She stated that, although they were two separate cases, a decision by the Oregon Supreme Court a mere 30-days before this jury trial prejudiced Judge Day’s right to an impartial jury.
As such, Judge Frantz granted the Motion To Change Venue.
Her decision was mostly based upon the Statesman Journal’s inaccurate and persistent reporting in the last week, especially the big article yesterday. The judge ruled that a change of venue is necessary. She also determined that Judge Day could probably never get a fair trial in Marion County. The trial will be set for October 17th, and for the 2 weeks following. As of now, we don’t know which county it will be moved to.
