The following was released by one of Judge Day’s sons.
I write with a strong desire to correct the media’s narrative surrounding my father’s criminal indictment last week. The media has overlooked the true reason behind the indictment of Judge Vance Day.
Since the dawn of civil government, powerful elites have sought to destroy others who are perceived to be a threat to their established order. Ruled by their ideology as opposed to their duty under the law, political assassination becomes the goal of those in power rather than the pursuit of justice. Ellen Rosenblum’s indictment of Judge Vance Day is a modern-day example of the clear incongruence in the Oregon Attorney General’s action and her duty.
On November 17, Judge Vance Day was indicted by the Oregon Attorney General for “aiding and abetting a felon in the possession of a firearm.” This criminal indictment, while posing as a remedy to the alleged threat my father represents, is nothing but the failed vestige of a political paradigm – namely, the politics of envy and personal destruction.
This paradigm of which I speak is nothing new to human nature. Envy, in contrast to jealousy, arises from a desire to see another human being destroyed for a quality that the destroyer lacks. In the case of my father, his destroyers lack empathy, a virtuous heart, and a mind on fire in pursuit of Truth. My father possesses all these traits – those accusing him, don’t. My father possesses an internal compass about what is good and right – they lack a true standard of justice.
When a group of powerful elites is tempted by envy’s vindictive promises, there is always one outcome – the pursuit of personal destruction. And in this pursuit of personal destruction, envy becomes the progenitor of compulsive dishonesty in order to justify that which it cannot rightfully claim as Truth.
There comes a time in the collective life of a community where “enough” truly becomes enough. When the threshold of tolerance for a system of unbridled intolerance is crossed, the people must wake up. When a veil of justice is exposed as a crude tool of vindictive force used by the political elite, the people must rise up.
If you have followed my father’s public shaming over the past 15 months, then you have been witness to the vicious series of dishonest accusations that my father has endured. These accusations are evidence of a malignancy that knows no bounds, and they are driven by the same spirit of the “new tolerance” that rears its ugly head in response to any alleged “bigotry.” My father simply recused himself from performing same-sex marriages as a judge. The cries from intolerant elites were deafening. Why couldn’t his beliefs be considered just as legitimate as their own progressive doctrines? Now they want to brand him as a criminal.
A disabled Navy veteran in my father’s Vet Court lacked heat in the dead of winter. My father volunteered to go out and see if he could fix the veteran’s pellet stove. My younger brother drove him to the house, and while my father was working on the pellet stove, my brother retrieved a gun box from his truck. He showed the unloaded gun to the veteran, who simply picked it up and demonstrated a combat maneuver for my brother. My father overheard the discussion and turned to look, noticing the veteran holding the handgun. In that context (being a good Samaritan and helping a veteran), it did not occur to my father in the moment that the veteran was a felon (the felony conviction was later reduced to a misdemeanor, as often happens – by design – in Vet Court cases). The interaction with the unloaded gun was brief and my father did not know that my brother even had the gun in his truck. My father did not “aid and abet a felon in the possession of a firearm.”
The Oregon DOJ calls the above interaction a crime.
Let’s call this indictment what it truly represents: a conclusion searching for evidence – a misuse of power – an injustice. When the “Department of Justice” misuses its authority for political purposes to crush a person with an opposing opinion, this is the essence of injustice. This crusade against my father is clearly wrong. By indicting Judge Day, the “Department of Justice” chooses to reveal the great incongruence between its name and its action. A government entity should never be used as a tool for injustice. Consequently, the nation has just witnessed the fruit of a politicized Oregon Department of Justice.
Many of us read of such tragedies and come to conclusions similar to those I’ve outlined here. But if we do nothing with our conclusions – if we stop there and fail to go further, we encourage those who practice the politics of envy and personal destruction.
So what will your response be? Will you stand with my father and with those who believe that his First Amendment liberties cannot be trampled upon by the elites in government? Will you stand against those who wield their power to crush others, like my father, who disagree with their agenda?
In writing this analysis, I am not appealing to your sympathy. My family is strong and will overcome whatever lies ahead. I am appealing to your reason. I aim to stoke a fire in you; a fire that burns until the day we all can say, “justice was finally upheld here.” This is our opportunity to define what standard of justice that the State of Oregon will abide by: a standard that upholds the rule of law and not the opinions of men. I for one am not going to miss my shot at making a statement. This will not be my last.
