Over two years ago the state of Oregon began desperately trying to figure out how to prosecute Judge Vance Day. The evidence shows that the State of Oregon investigated numerous parts of Judge Day’s background trying to find some violation of the law. Despite evidence to the contrary, the Oregon Department of Justice chose to charge Judge Day with crimes that never happened.
In doing so, the State of Oregon chose to criminalize political differences. This case was never about a gun – it has always been about the power elite attempting to enforce a political agenda. They were sending a message: If you don’t get in line and celebrate our perspective on marriage, we will find you ineligible for public service.
The immense power of the state should never be weaponized in order to achieve a political objective. In our republic, we have long recognized the source of our unalienable Rights. Rights, given to us by our Creator, cannot be taken away by the state.
Liberty of conscience is the cornerstone of our liberties. Judges have constitutionally protected liberties, too. An independent judiciary is vital to how our republic functions. The increasing trend toward “thought conformity” within the judiciary is a malevolent danger – it threatens the Rule of Law.
The message the state intended to send by prosecuting Judge Day is: conform or be punished. Thankfully, the house of cards upon which the state’s case was built has collapsed. They finally recognized, two days into selecting a jury, that their charade is over, and the State of Oregon has dismissed the political prosecution against Judge Vance Day. Judge Day still faces an Oregon State Bar attempt to sanction him. We will stay with him in his continued battle. Our hope is that the citizenry of this nation recognizes the immense threat to constitutional liberty and the Rule of Law created by politically motivated prosecutions.
